Hillary Clinton hospitalized with blood clot

WASHINGTON (Reuters) - U.S. Secretary of State Hillary Clinton was sent to the hospital on Sunday with a blood clot stemming from a concussion she suffered earlier this month and was being assessed by doctors, a State Department spokesman said.

"In the course of a follow-up exam today, Secretary Clinton's doctors discovered a blood clot had formed, stemming from the concussion she sustained several weeks ago," spokesman Philippe Reines said in a statement.

"She is being treated with anti-coagulants and is at NewYork-Presbyterian Hospital so that they can monitor the medication over the next 48 hours," Reines said, adding that doctors would continue to assess her condition.

"They will determine if any further action is required," he said.

U.S. officials said on December 15 that Clinton, who earlier canceled an overseas trip because of a stomach virus, suffered a concussion after fainting due to dehydration.

They have since described her condition as improving and played down suggestions it was more serious.

Clinton's illness forced her to cancel planned testimony to Congress on December 20 in connection with a report on the deadly attack on the U.S. diplomatic post in Benghazi, Libya, in September that killed the U.S. ambassador and three other Americans and raised questions about security at far-flung posts.

Clinton, 65, has said she remains ready to testify and was expected to appear before congressional committees this month before she steps down, as planned, around the time of U.S. President Barack Obama's inauguration in late January.

Clinton, who narrowly lost the Democratic presidential nomination to Obama in 2008, is consistently rated as the most popular of his cabinet members and is often mentioned as a potential presidential candidate in 2016.

Va. Tech edges Rutgers in OT in Russell Bowl

ORLANDO, Fla. (AP) ? After one of its most unfulfilling seasons in recent memory, Virginia Tech desperately wanted to avoid its first losing season since 1992.

Mission accomplished.

Cody Journell kicked a 22-yard field goal on the first possession of overtime to help the Hokies beat Rutgers 13-10 in the Russell Athletic Bowl on Friday night.

Virginia Tech won its final three games to finish 7-6.

"Not everything in life is real smooth," Hokies coach Frank Beamer said. "These players worked hard and how they reacted to adversity and to disappointment and when all of them wanted to do better ? they kept together."

Rutgers (9-4) had a chance to tie it in overtime, but Nick Borgese missed a 42-yard field-goal attempt to the right.

The loss ended a run of five straight bowl victories for the Scarlet Knights and kept them from recording their first double-digit win season since 2006.

The win also was the Hokies' 12th straight victory over their former Big East Conference rival.

Virginia Tech trailed 10-0 at the half, then rallied in the final 30 minutes thanks to some timely turnovers and offense. Quarterback Logan Thomas struggled in the first half and finished with a pair of interceptions, but also had 192 yards passing and the game's only passing touchdown.

"I can't commend the defense more," Thomas said. "The entire season that's kind of how it's been. I have to give a shout out to (linebacker) Bruce Taylor because he played his tail off the entire game. It felt like he was in the backfield making a tackle on every play."

Taylor finished the night with a team-high 11 tackles to lead a defense that held Rutgers to 67 yards in the second half.

Virginia Tech cornerback Antone Exum, selected the most valuable player of the game, picked off Gary Nova's pass early in the fourth quarter to set up the tying score.

He said though the offense took its lumps early, he was never down on their effort.

"That's just the way the game panned out," Exum said. "We never lose hope with the guys on the other side of the ball. Our job, honestly, is just to go out there and get as many three-and-outs as possible and give the most opportunities as we can to put points on the board.

"We did a good job of that tonight."

Rutgers seemed to be in command until the opening minutes of the fourth quarter, when turnovers and a sudden surge from the Hokies' offense quickly turned the momentum.

Down 10-0, Virginia Tech took over after Rutgers missed field goal and moved into Scarlet Knights' territory for the first time in the game on a 32-yard pass from Thomas to Dyrell Roberts.

Thomas then found Corey Fuller for a 25-yard strike on the next play, before the drive stalled on the 8. It forced the Hokies to settle for Journell's 25-yard field goal.

Exum intercepted Nova's pass on the ensuing drive, giving the Hokies a first down on the Rutgers 21.

The Hokies found the end zone three plays later on a 21-yard touchdown pass from Thomas to Fuller with 10:56 left as steady rain began to fall.

"We finally caught them off balance," Thomas said. "We finally got them uncomfortable. ... I just had to put the ball out there for him."

Virginia Tech defensive end Tyrel Wilson then came up with the defense's second turnover of the night, recovering a fumble inside the Scarlet Knights 40 after Nova dropped a snap while lined up in the shotgun.

An intentional grounding penalty on Thomas forced a punt, though, with less than 7 minutes to play.

They got another chance a few series later, only to see Journell's 51-yard field goal come up short with 2:20 showing on the clock.

Rutgers punted, but got it back just a play later when Thomas' pass was intercepted by Brandon Jones.

"Two tremendous defensive performances, and one of the better defensive performances I've seen from Rutgers players this season," Rutgers coach Kyle Flood said. "It's unfortunate that we came out on the wrong side of the game, and squander that kind of performance as a result."

It was defense on both sides that controlled the action in the first half as Rutgers took a 10-0 halftime lead.

The Scarlet Knights were the most effective offensively, managing a modest seven first downs and a field goal. But the Scarlet Knights came up empty on their best drive of the half, failing to convert on a fourth down pass play inside the Hokies 35.

Virginia Tech struggled throughout, though, tallying only 73 yards total in the first two quarters. Thomas was also sacked twice and intercepted late in the half, which severely hampered an offense that never made it into Rutgers' territory.

Penalties also bent in Rutgers' favor. Virginia Tech was penalized eight times for 60 yards. The Scarlet Knights weren't whistled for any penalties in the half.

A miscue by Virginia Tech on the opening drive of the game produced the game's first score.

Hokies center Caleb Farris sent his second snap of the night sailing past Thomas and into the end zone.

Thomas scrambled back to pick it up, and tried to run it out, but he was instantly swarmed and lost the ball as he was tackled. It was eventually recovered by Rutgers linebacker Khaseem Greene for the touchdown.

Beamer said the challenge to not any shortcomings from this season cloud the offseason.

"I couldn't be more proud of this team," he said. "We've won some more games in other years, but I think this group is special."

Notes: The game was the lowest scoring the bowl's history. It surpassed Stanford's 24-3 win over Penn State in 1993. ...The game also set a bowl record with 20 punts, passing the previous record of 19 in the 1991 matchup between Alabama and Colorado.

Were there signs Ben Sebena was in need of help? | FOX6Now.com ...

WAUWATOSA ? One expert tells FOX6 News there may have been signs that accused killer Ben Sebena was in need of help. Sebena is charged with killing his wife Jennifer outside of a fire station in Wauwatosa on Christmas Eve.

Sebena, a Marine and recipient of the Purple Heart, was suffering from post-traumatic stress disorder (PTSD). In a 2010 YouTube video made by his church, Sebena told of his struggles.

Sebena opened up in the video about how he was nearly killed by a mortar attack in Iraq. He talked about his issued with PTSD ? and more importantly what he said had helped him overcome those issues.

?The moment I got there, there was so much love, and so?much joy in the room that all my fear left me,? said Ben Sebena in the video.

Sebena was on the road to recovery not only through his congregation at Elmbrook Church, but with the help of the local Veterans Administration. Sebena was taking yoga at the hospital for therapy. He was quoted in a 2010 magazine article about the program saying, ?It?s very relaxing? My wife has supported me and this is my gift?back to her. She doesn?t want me to repress feelings. I owe her.?

But Dr. Ashok Bedi, an expert on PTSD, says there were signs that Sebena was struggling. Elmbrook Church indicated Sebena had not been an active member in recent time. Dr. Bedi says nothing is more healing than structure.

?If you drop out it is always a very dangerous sign. It?is important to continue that thread, that continuity, of that support,? said Dr. Bedi.

Dr. Bedi says those suffering from PTSD who are not getting support are quickly agitated and lose a sense of reality.

?Someone who has PTSD is likely to perceive a sense of?betrayal by others. They easily feel betrayed, they feel overwhelmed,? said Dr. Bedi.

Dr. Bedi says PTSD is a growing problem in our society, but one that can be managed with help.

It?s obvious the Giants defense isn?t what it once was.

But if you ask their defensive coordinator why, he makes it clear it?s not the coaching.

?We?ve prepared better than what we?ve played,? Perry Fewell said, via Ralph Vacchiano of the New York Daily News. ?I think if you look at the tape we?re in position to make plays. We haven?t made plays.?

While coaches default into self-preservation mode this time of year, it?s hard to pin the blame for the Giants? precipitous slide on one man.

They were seventh in the league in total defense in 2010, and won a Super Bowl a year ago. This year, they?re 30th in total defense.

But mostly, they?ve been awful when it counted most, allowing 67 points in their last two must-win games, which leaves them only a slim conditional chance at the playoffs heading into the final weekend.

?We?ve been in position,? Fewell said. ?We haven?t made a football play for the last couple of weeks. We?ve been in position to make football plays, but it hasn?t gone our way.?

If there?s a sign that players know Fewell?s right, it?s that there?s no open or indirect grumbling about him yet.

?We won a Super Bowl in this system ? I think that?s the main thing,? linebacker Mathias Kiwanuka said. ?We had the same system that we did last year.?

?There?s a lot of support for Perry,? defensive end Osi Umenyiora added. ?I?ll just say that.?

Of course, the Giants were trending this direction defensively last year, finishing 27th in the league. But their play late in the year was much of the reason they won a title, so that fades from memory. That?s added some insulation for Fewell, and any offseason changes should rightly begin with personnel.

He?s had chances to interview for head coaching jobs in the past (and the Panthers may have made a significant mistake picking Ron Rivera over him), and will likely continue to. But until he gets one of those jobs, he?s left trying to scheme for an aging cast which needs a re-tooling.

How would you persuade kids and teens to read? ? Kids Playgrounds

I want to start a project on my community, where reading is emphasized.
Dealing with kids and teenagers, what would you tell them to catch their attention so they can start to read more books and spend less time stuck to their electronic devices?

Lol well since i am somewhat a teenager.. I can help-ish. What makes me want to read is if its a really good book, and people usually dont emphazise what a book is about like if u went to the library and asked the librarian if this is a good book, usually shed just tell u whats on the back, but normally ppl dont realize that the book usually doesnt get good until around page 50 or so. And people read like the first page and their like "this is stupid im done." so maybe to get them to read books you can tell them whats in the middle and how good it really is if you want them to read a specific book.
If you want kids to get out and play, make something fun to do! Usually all you can do outside is.. What.. Go on a swing? Kick a rock? Throw a ball? Thats not very intiresting once you hit age 9. (im a girl so i dont speak for boys lol) so get a trampoline, build a zipline on the other end. To be honest playing on an ipod or laptop or whatever is a lot funner then kicking a little ball outside. make something fun to do! If your expecting kids to go outside, idk what you expect cause there really is nothing if you ask me. I mean, i know there is a lot you can do but if they kid is like sitting inside being bored and u tell them to go outside when all they have is a swing and a ball and theyre like 13, unless they have a friend it isnt fun. Sorry if this was really long!

Netflix suffers Christmas Eve outage, points to Amazon

NEW YORK (Reuters) - An outage at one of Amazon's web service centers hit users of Netflix Inc.'s streaming video service on Christmas Eve and was not fully resolved until Christmas day, a spokesman for the movie rental company said on Tuesday.

The outage impacted Netflix subscribers across Canada, Latin America and the United States, and affected various devices that enable users to stream movies and television shows from home, Netflix spokesman Joris Evers said. Such devices range from gaming consoles such as Nintendo Wii and PlayStation 3 to Blu-ray players.

Evers said that the issue was the result of an outage at an Amazon Web Services' cloud computing center in Virginia, and started at about 12:30 p.m. PST (2030 GMT) on Monday and was fully restored Tuesday morning, although streaming was available for most users late on Monday.

"We are investigating exactly what happened and how it could have been prevented," Evers said.

"We are happy that people opening gifts of Netflix or Netflix capable devices can watch TV shows and movies and apologize for any inconvenience caused last night," he added.

An outage at Amazon Web Services, or AWS, knocked out such sites as Reddit and Foursquare in April of last year.

Amazon Web Services was not immediately available for comment. Evers, the Netflix spokesman, declined to comment on the company's contracts with Amazon.

Across three pages ??typed on Christmas Eve 1966 from a village in South Vietnam???the soldier?s words to his wife dance seamlessly from a description of singing carols in the jungle to his latest enemy kills to, finally, a vow of eternal affection.?

?Last night we had a candle-lighting ceremony ... Gasoline drums welded together end to end with a white Noel on the side. Electric light on top covered by red cellophane ... Reindeer and Santa Claus at front. It was raining,? Army Gen. Sidney B. Berry wrote to his wife. He next reveals how he recently had perched in a helicopter door, firing his rifle at men below: ?We all were shooting. And we killed several ...?

?Lovely Anne, I love thee,? Berry closed. ?Perhaps the best aspect of this whole period of separation is our increased appreciation and understanding of each other. I love thee, and I will devote the rest of my life to making love to thee.? He signs off: ?Thy wearied professional, Sid.?

This time of year, communication from combat lines has long provided a poignant piece of Christmas.

Today's troops, for the most part, send their holiday wishes via email or Skype video chat sessions. But life was much different before technology began shadowing ?service men and women so far from home.

At the U.S. Army Heritage and Education Center in Carlisle, Pa., thousands of notes, authored by service members from conflicts past, are painstakingly stored in acid-free folders, tucked inside protective boxes, and categorized by family, forming numerous narrow rows flanked by shelves 10 feet high. Many of the correspondences, once jammed in attic boxes, have been donated to the archive. Museum directors retrieved several dozen Christmas missives for NBC News to review.

From the Civil War to the Vietnam War, troops ranging from privates to a general struck the same literary chords???no matter the success of their conflict, their era, or the location of their last battle. They often chronicle violence during a moment meant to celebrate peace. They typically express humor, perhaps to put families at ease. And they reveal yearnings to be back with gathered families and friends.


?A lot of people wrote letters to their mothers at Christmas. I guess it?s a time you really start to think about home, really start to think about where you come from,? said Conrad Crane, chief of historical services at the Army Heritage and Education Center.

Some of the letters offered to NBC News were were originally mailed to nieces, parents and wives.?

John T. Cheney, an officer in the U.S. Army during the Civil War, wrote to his wife from Mississippi in 1862.

On Dec. 28, 1862, five months before the U.S. Army?s siege of Vicksburg, 1st?Illinois Light Artillery Capt. John T. Cheney sat at a humid encampment, he wrote, near the Tallahatchie River in Mississippi and scribbled some lines to ?My Dear Wife.? Her name was Mary. He also had two children at home at the time, including an 11-year-old son, military archives show. On now-yellowed paper in cursive style, Cheney mentioned to Mary that he was, ?waiting to retreat????revealing, however, he believed his unit ?ought not to be compelled to do so.? He told her that he and his men were living off of half bread rations and three-quarter meat rations but he reassured her that he was ?not yet out of medicine.? And he acknowledged that on Dec. 24 he had procured three gallons of whiskey for his men: ?We had a very pleasant Christmas Eve.?

?I am quite well and could I only know that you were well at home I would be thankful,? Cheney wrote. Less than two years later, he would accompany Gen. William Tecumseh Sherman?s famous march on Atlanta. ?I wish I could step in and stop with you all tonight ... Give my love to all of the friends and kiss the little ones for me a time or two ... Good night.?

While training to head to combat in World War I, Adam F. Glatfelter offered some soothing words to a niece.

Not surprisingly, the intended audience of each letter, Crane said, generally shaped the tone of words from the front. The museum has ?steamy? notes from husbands to wives, he said, and fatherly notes to children.?

On Dec. 26, 1917, Adam F. Glatfelter penned some thoughts to his niece, Carrie, from Camp Gordon in Atlanta. The training center was built to prepare men to head to the trenches of Europe to fight during World War I. In cursive hand, using a pencil, he told her of spending Christmas Day playing music with his military orchestra for the local bishop. He joked that his ensemble was quickly becoming ?pretty popular? with folks in Atlanta. He listed his holiday meal: two turkey dinners. And he thanked her for sending a spool of thread.

?Do not worry about me,? he wrote, signing as ?Uncle Frank.?

Holiday menus???and pleas not to fret???color many Christmas letters home. On Dec. 25, 1944, Navy Pfc. Clark S. Crane dashed off a one-page note to his parents in a V-mail, short for ?Victory Mail.? Crane was anchored near the Philippines at the time, according to the Army Heritage and Education Center, although his letter notes he was ?Somewhere at Sea.? He tells his parents how he had ?just finished extending season?s greetings ... good natured but well felt? to other men on board via a Christmas poem that he authored with another sailor. He offered one line for his folks.?

??Shed a tear in your Christmas beer since there ain?t gonna be no egg in it this year.? Pretty corny, eh?? Crane wrote, noting that was his third Christmas spent at war and away from his parents? house at 285. N. Maple Ave. in Kingston, Pa.

?Lined up ... for Christmas dinner with tender turkey and cranberries on the menu,? he wrote. ?All of it was very good but there was a deficit of brown skin and the savory smell of a Christmas turkey at good old 285 North Maple. Lots of Love, Clark.?

Another poem???albeit a modern, bloody take on the classic ?A Visit from St. Nicholas????formed a Christmas letter home from Douglas G. Anderson, then stationed in Korea. Neatly hand-written on green paper, the note contained no date or location. Records show he was an Army sergeant who would have been about 23 at the time.

The shoe pacs were hung by the oil stove with care in hope that they?d issue each man a new pair. The weary GIs were sacked out in their beds. Visions of sugar babes danced through their heads,? Anderson wrote.

?When up on the ridge-line there arose such a clatter, a Chinese machine gun had started to chatter. I rushed to my rifle and threw back the bolt, the rest of my tent mates arose with a jolt.? Staying in rhyme, Anderson described the orders shouted by his platoon sergeant, Kelly. ? " 'Get up on that on hilltop and silence that red and don?t you come back till you?re sure that he?s dead.' Then putting his thumb in front of his nose, Sergeant Kelly took leave of us shivering Joes. But we all heard him say in a voice soft and light ?Merry Christmas to all, may you live through the night."

After the birth of the Internet and as modern service members waged war in Iraq during two conflicts and, now, in Afghanistan, the art of the Christmas letter home has largely been replaced by Skype sessions, said Col. Matt Dawson, director Army Heritage and Education Center.

In historic missives from combat zones, ?people bared their souls,? Dawson said. Some of the authors couldn?t be sure that those words wouldn?t be the last their families would receive from them.

Today, such intimate moments are shared during one-one-one cyber chats that rarely, if ever, are saved???unless the troops use a new service called TroopTree.com in which they can record, upload and send personal video messages for family or friends, and do so at no cost.

In most cases, however, sweet sentiments shared during Skype sessions from war zones are simply here and gone.

?So in 20, 30 or 40 years," Dawson said, "when we?re looking for this kind of stuff from the war in Iraq or Afghanistan, it will be more difficult to find," ? unless a service member takes time to mail a post card home, as Marine Sgt. Brian Snell?did this month. He sent the card to his wife Liz and their two daughters. The front shows a red Christmas ornament stamped with an ?Operation Enduring Freedom? logo, atop an American flag.

"Hey love, Hope you girls have a Merry Christmas and New Year. I miss you all,? Snell, 30, wrote to his family, who live in the San Diego area. This is his first deployment. He was sent to Afghanistan in autumn.

?There is something about being able to read his handwriting to make the world feel a little smaller, like he isn't on the other side of it,? Liz Snell said. ?Unlike a phone call, a letter lingers. You can have a bad day, pick up the card, and he is here.?

MINNEAPOLIS (WCCO) ? Todd Oakes is the pitching coach at the University of Minnesota, and he will return to work Wednesday, amazingly.

Oakes is a husband, a father of three pitchers and a man who has been fighting for his life the last six months. That?s what makes this Christmas so special.

A Sports Family

The Oakes boys are bonded by much, starting with baseball. That?s where their father has coached two of them at the University of Minnesota. And it was there he was coaching last year when he felt rundown.

?It came down during our baseball season,? Oakes said. ?I was just really rundown, tired, fatigued more than normal.?

The problem was acute myeloid leukemia, and it meant 80 days in the hospital and a bone marrow transplant.

?It was definitely a shock, obviously didn?t see it coming,? said Oakes? son Tanner, who pitches for Augsburg. ?But we went through it together, handled it pretty well, and it brought the family together.?

Oakes? family and baseball attitude are intertwined ? built to compete, play as a team.

?You know, the three things that got me through this are faith, family and friends,? he said.

The family had supporting phrases and made T-shirts to help Oakes in his struggle.

But it wasn?t just the three boys and dad in the fight, there was the most valuable mother and wife.

?She?s a tough lady,? said Tyler Oakes, one of Oakes? sons and a former Gopher pitcher. ?My dad calls her the MVP of the family.?

Dad was a one-time professional pitcher himself. And Oakes has instilled in his sons the spirit to compete, be supportive teammates, and, in this case, a supportive to their family.

This Christmas, the Oakes family gathered with appreciation for everything.

?I?ve said I?m a changed person,? Oakes said. ?I think the biggest thing you learn?is just appreciate the little things in life.?

    Ultrasound diagnoses appendicitis without X-rays

    Dec. 24, 2012 ? Children suspected of having appendicitis are more likely to receive CT scans, which involve radiation, if they are evaluated at a general hospital, a new study by Washington University School of Medicine in St. Louis has shown.

    Similar patients who went to St. Louis Children's Hospital were more often evaluated with an ultrasound scan, a safer option that uses sound waves instead of radiation to confirm or rule out the need for surgery to remove the appendix.

    Use of either scanning technique can potentially reduce the occurrence of unnecessary surgeries and expedite the diagnosis of appendicitis. But recent reports have suggested that the radiation exposures in CT scans can significantly increase children's lifetime cancer risk. As a result, researchers are reassessing the role of CT scans and seeking ways to reduce their use.

    The study appears online Dec. 24 in the journal Pediatrics.

    "Appendicitis is a very tough diagnosis, because its symptoms overlap with viral infections and other problems," says first author Jacqueline Saito, MD, assistant professor of surgery. "We don't want to operate when the appendix is fine, but if we wait too long, an inflamed appendix can rupture or perforate, making recovery more complicated and much slower."

    The appendix is a finger-shaped pouch that extends from the large intestine. Infection or blockage of the appendix causes appendicitis, which can lead to abdominal pain, vomiting and fever.

    Saito and her colleagues analyzed case records of 423 children who had appendectomies, or surgery to remove the appendix, at St. Louis Children's Hospital. In 218 patients initially evaluated at Children's Hospital and 205 at general hospitals, researchers reviewed how the patients were evaluated for appendicitis and whether the surgery's results confirmed the diagnosis.

    CT scans, which take X-ray images from multiple angles, have been the primary diagnostic scan for detecting appendicitis for many years. About 85 percent of children initially evaluated at a general hospital underwent preoperative CT scans, and 45 percent of children initially seen at St. Louis Children's Hospital had CT scans. Using ultrasound to detect appendicitis has recently become more frequent, especially at St. Louis Children's Hospital; over half of children initially seen at St. Louis Children's Hospital, compared to 20 percent at general hospitals, had preoperative ultrasound.

    Only 7 percent were not scanned using either method, and 15 percent had both types of imaging.

    While ultrasound scans are safer for diagnosing appendicitis in children, they must be performed and interpreted by personnel who have received specialized training and are familiar with pediatric diagnostics.

    "Ultrasound scans are difficult to perform correctly in this context, and what specialists can do at Children's Hospital may not be realistic or even available in a general hospital, which doesn't care for children as often," Saito says.

    Saito is currently studying the outcomes of patients whose scans ruled out an appendectomy, looking to see if they had any additional symptoms or eventually had to have their appendixes removed.

    "Ultimately what we'd liked to do is learn how we can reduce our use of CT imaging without compromising patient care," she says. "We want to find ways to identify the patients who really need these scans and those who can be effectively evaluated using other methods."

    Jackson Bird, the Tasmanian fast bowler, will play for Australia after Head Coach Mickey Arthur confirmed his inclusion for the upcoming Boxing Day clash against Sri Lanka.

    His strength lies in accuracy, rather than express pace, and combined that with the ability to swing and seam the ball, he becomes a difficult customer to get away. Arthur is well aware of his prowess, and has put faith in the bowler to get the job done when he takes the field against Lankan. Bird has an impressive record at the MCG, where he has claimed 14 scalps in two first-class matches.

    "When he went down to Tassie he has bowled unbelievably well, he's taken 50 wickets last season and well on the way, leading wicket-taker in the Shield this year," Arthur said. "He brings line and length, he brings pressure, he swings the ball out, he brings some nice pace. He's got all the attributes of a quick bowler. We've got a lot of faith in Jackson. At the start of the summer we had a list of bowlers that we wanted to keep fresh and keep ready to go and Jackson was one of them."

    Bernard Starr: Legal Issues in Self-Publishing: What Authors Need ...

    Self-publishing continues its exponential growth. More and more authors are choosing this route for presenting their work to the public, encouraged by impressive success stories, including accounts by bestselling writers who have moved over from traditional publishing to take advantage of greater profits and better control of their works.

    But there is one domain that self-published authors rarely think about, which mainstream publishers have traditionally managed: legal issues.

    If you self-publish, you are the publisher and thus assume all the legal responsibilities. At first this might seem frightening. But it doesn't have to be, as I discovered in my interview with Paul Rapp, an attorney who specializes in intellectual property rights in Monterey, Mass. and teaches Art & Entertainment Law and Copyright Law at Albany (N.Y.) Law School. He also discusses copyright issues in publishing on Vox Pop on Northeast Public Radio.

    Rapp says he is working increasingly with self-publishers and self-published authors. He cited the prominent legal issues that authors should pay attention to: The use of images, quotes, and other materials from copyrighted works, the use of public domain works, the amount of a published works that can be quoted, portrayals of real people in fictional works, the standards for portraying famous and non-famous persons, portrayals of real people in non-fictional works, and the importance of copyright registration.

    Starr: Isn't the provision of legal services an area where traditional publishing offers an edge to authors?

    Rapp: The issues don't go away whether you are publishing traditionally or self-publishing. While the legal department of a publishing house may assess the legal issues in a work and advise, or demand changes if necessary, that doesn't release the author from responsibility. Every publishing agreement that I have ever seen has an indemnification clause in which the author agrees to hold the publisher harmless if there are claims against the publisher for any infringement or violation of personal rights. That being said, most publishers vet books before they go out and have insurance policies that cover most of these lawsuits; the insurers may also vet a manuscript prior to publication. But I think this is happening less and less, leaving the author exposed. And I'm seeing a lot of agreements that, particularly for non-fiction books, require the author, rather than the publisher, to get necessary permissions and licenses to use any third party material.

    Starr: What advice do you have for self-publishing authors who have legal concerns?

    Rapp: If authors have legal questions and want peace of mind they should get a legal opinion from an attorney. Because of the expansion of self-publishing there are an increasing number of lawyers who will assess legal issues in a book and tell you how to address the problems for a fairly nominal fee. For example, I just finished reading a book on branding. It took a couple of hours. Many lawyers will charge for how long it takes to read the book and prepare an "opinion of counsel" letter. Unless there is a huge systemic legal problem with the book, the letter should generally be one or two pages long. An opinion of counsel letter is a form of insurance; if an author is eventually found to have violated anyone's rights, an opinion of counsel letter can at least absolve the author of any claim of willfully violating those rights.

    Starr: I have found that licensing fees are being charged that are not justified under copyright law for the use of public domain photos, artworks and other public domain works.

    Rapp: Whether those demanding a fee for a public domain work believe it or not, they want you to believe they own a copyright that they don't own so they can exact a fee. Images or text in the public domain do not require permissions or licenses, period. And a mere photograph of a public domain work is itself in the public domain because there hasn't been anything significant added by the photographer to the original. And if an author receives a threatening letter about the use of a public domain work, it's because institutions know from experience that if they threaten, many people will pay up. Usually a brief letter from an attorney, or just ignoring the threat altogether if it's baldly frivolous, will be a proper response.

    Starr: What about the use of quotes. Is there a limit to how many words you can quote? One editor told me that 300 words was the limit. Elsewhere I've read that it's related to the length of the work you are quoting from and the length of your book.

    Rapp: There are no absolute rules like that and people always say there are. There is no fixed rule about the number of words. If the quote drives your narrative, or if you are commenting on the quote or its author, or using a quote to support an argument then it's most likely going to be a "fair use" of the quote, and therefore non-infringing. The publisher of the work you are quoting from may squawk, but it's highly unlikely that they are going to do anything about it. Some publishers have their own standards for how much an author can quote in a book they are publishing in order to somehow justify their own complaints about extensive quotes from their books in works put out by other publishers.

    The one tricky area is when people use quotes that are just window dressing. Like when an author quotes the lyrics of a song -- even just couple of lines from a song at the beginning of a chapter, as Stephen King often does. Most music publishers take the position that you need permission because this kind of use, they claim, is not driving the narrative or otherwise a fair use. And they may be right -- the fair use doctrine is horribly imprecise. I've had authors ask me what to do. In those gray area cases, I suggest that they try to get permission. Often the licensing fee is fairly minimal -- although it depends on the song and the publisher.

    I recently had an author who was putting out a self-published book that had a scene in a bar where a popular song was playing on the jukebox. He quoted the lyrics that were actually mirroring what was going on in the bar. It was really funny. And I said, that's fair use and you don't need permission because it's integral to the narrative of the work. The publisher might disagree but I say go ahead and use it.

    Starr: If you don't get the permission and they come after you what will they demand?

    Rapp: Most likely an after-the-fact license. In some cases they may demand the book be taken off the market, but most typically they'll be happy with a license. And again, in the situations I've outlined here, a license is not necessary, and their demands are bluffs.

    Starr: The bar room story reminds me that I once wrote an article about "positive psychology." I used the lyrics from the famous song, "Accentuate the Positive," to show that the words expressed the entire philosophy of positive psychology. At the time it never occurred to me that there might be a legal issue.

    Rapp: That's a classic example of fair use since the words are integral to the point you are making.

    Starr: Whew. I'm glad you got me off the hook. Now to the sensitive issue of naming and portraying real people in fiction and non-fiction works.

    Rapp: If the person is famous you can say pretty much whatever you want, particularly if it's an opinion; the first amendment protects your rights on that. If you state a fact you know is untrue, that may cause the famous person harm, and that most people will tend to believe, that's over the line. Now if it's a private person, someone who is not famous, and you write about that person by name and disclose things not known to the general public that might be embarrassing or might hold that person up to ridicule then you've infringed their privacy rights -- it's called the public disclosure of private facts.

    This happens a lot in non-fiction books where the author portrays a non-famous person in a very unflattering way. Even if what the author says is true the person's privacy rights have been violated.

    Starr: What if an author writes about a famous person's romantic or sexual affairs and offers analysis or diagnosis of the person's personality and motivations -- even suggesting psychopathology?

    Rapp: Again, if it's a famous person and you are expressing your opinion and representing the truth fairly accurately, the first amendment would strongly protect your right to say what you want. The divide is famous vs. non-famous. And even if you make stuff up about a famous person, if it's not something that's believable you can do it. Hustler magazine ran a fake Campari ad featuring evangelical pastor Jerry Falwell talking about having sex with his mother in an outhouse.     Some celeb pets have had a great 2012 ? others, not so much. Kristen Stewart?s cheating scandal couldn?t keep her and Robert Pattinson?from getting back together and nurturing their ?baby? dog Bear?and adopting a second rescue dog Bernie. Justin Bieber, on the other hand, threw his pet hamster PAC at a fan. Either way, let?s look back at all our favorite celeb pets and tell us which one YOU love the most!

    Selena Gomez?s adorable adopted dog Baylor is all grown up. She posted this picture of him in August ? definitely not a puppy anymore!

    While many pets were loved and cared for by their celeb owners, some pets didn?t do so well this year. Honey Boo Boo was forced to get rid of her pet pig Glitzy, while Kim Kardashian?s kitten Mercy, a gift from her boyfriend Kanye West, met an untimely death. Although she still made a cameo in the family Christmas card. RIP Mercy.

    I may be biased, but I think?Taylor Swift?s kitten Meredith should win cutest pet of the year. Few pets have the personality of Meredith. In a Dec. 18 video, Meredith sings along with Taylor as her song plays on the radio. And then goes fetch! Like a dog! But she?s a cat! Watch it below.

    Vikings deny Texans home-field playoff advantage

    HOUSTON (AP) ? The Houston Texans slowed down Adrian Peterson. The same couldn't be said for how they handled the rest of the Minnesota Vikings.

    Peterson rushed for 86 yards, falling far short of the 2,000-yard mark, yet helping the Vikings (9-6) keep their playoff hopes alive with a 23-6 upset of the Texans on Sunday.

    Christian Ponder threw a touchdown pass, Toby Gerhart added a score and Blair Walsh kicked three field goals.

    The loss kept the Texans (12-3) from clinching home-field advantage throughout the AFC playoffs. They could still secure a first-round bye if Denver loses later Sunday.

    Peterson had his lowest rushing total since getting 79 yards on Oct. 14 in a loss at Washington, breaking a streak of eight 100-yard games. He has 1,898 this season and needs 208 yards to break the NFL single-season rushing record held by Eric Dickerson.

    The Vikings took a 10-3 lead when Walsh kicked a 56-yard field goal. The kick gave Walsh, a rookie, the NFL record with nine field goals of 50 yards or longer this season.

    The Texans failed to score a touchdown for the first time since 2006.

    J.J. Watt had a sack to leave him with 20 1/2 this season.

    Houston got within 10 points before Gerhart's 3-yard run extended the lead to 23-6 with about five minutes left in the fourth quarter. That drive was helped by a 29-yard run by Ponder.

    Ponder was 16 of 30 for 174 yards to help the Vikings pile up 345 yards. He finished with seven rushes for 48 yards ? 14 more yards rushing than the Texans had. Arian Foster had 10 rushes for 15 yards before leaving with about nine minutes left in the third quarter with an irregular heartbeat. Coach Gary Kubiak said he is OK, but he was taken out as a precaution.

    Ben Tate took over and didn't fare much better with four carries for 17 yards.

    The Texans were foiled by their inability to convert third downs, going 1 of 11. Quarterback Matt Schaub went 18 of 32 for 178 yards.

    Houston got to the Minnesota 1 with a 12-yard reception by Kevin Walter late in the third quarter. Then came an incomplete pass followed by a run for no gain by Tate. Schaub was sacked by Fred Evans for a loss of 14 yards to make the Texans settle for a 33-yard field to cut the lead to 16-6.

    Houston had to punt on its first possession of the third quarter, but got the ball right back when Watt sacked Ponder and forced a fumble. Bradie James recovered, but the Texans couldn't take advantage of the miscue and had to punt again.

    The Vikings extended their lead to 16-3 when Walsh made a 39-yard field goal on the first drive of the second half. That series was helped when Ponder found Jarius Wright on a 15-yard reception, and the Vikings got 15 more yards when Whitney Mercilus was flagged for unnecessary roughness on Ponder.

    Houston was on the Minnesota 28 early in the second quarter when Jasper Brinkley forced Foster's fumble, which was recovered by A.J. Jefferson.

    Houston had to punt later in the second quarter when Schaub was sacked for a 9-yard loss. A 41-yard field goal by Walsh left Minnesota up 13-3 at halftime.

    Peterson ran for 20 yards to get Minnesota's offense going. The Vikings took a 7-3 lead when Kyle Rudolph grabbed a 3-yard touchdown reception. Rudolph also had a 27-yard catch that drive.

    Houston's Andre Johnson had seven receptions for 97 yards.

    Gerhart finished with eight carries for 31 yards.
